Recess to Closed Session pursuant to Wisconsin Statutes 19.85(1)(g) Conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved, re: Delavan Resort Holdings, Inc. performance or non-performance of Development Agreement and amendments thereto.

 

  1. Reconvene to Open Session to consider and take possible action on matters discussed in closed session re: Delavan Resort Holdings, Inc. performance or non-performance of Development Agreement and amendments thereto, and possible action to rescind amendment #2 to the Development Agreement.

**Note: A quorum of the members of the Water and Sewage Commission who are not also Council members may be in attendance to gather information and participate in discussion about an issue over which they have decision making ability. This may constitute a meeting of the Water and Sewage Commission pursuant to State ex rel. Badke vs. Greenfield Village Board, 173 Wis. 2d 553, even though the Water and Sewage Commission will take no formal action at this meeting. This meeting must be noticed appropriately and is intended to comply with the requirements of Badke and the Wisconsin Open Meetings Law.
